Vuttara remains MIT-licensed open-source software. These Terms govern the official website, installers, updates, support, branding, and future hosted services without reducing MIT rights.
1. Agreement to these Terms
These Terms of Service (“Terms”) govern your use of the official Vuttara website, official Vuttara installers and binary distributions, official update services and release channels, and any future Vuttara-hosted services operated by Ward Reynolds. By installing or using an official Vuttara distribution or using an official hosted service, you agree to these Terms. If you do not agree, do not install or use the official distribution or service.
The separate Privacy Policy explains information practices and is acknowledged separately during an interactive installation.
2. Operator and contact
Vuttara is developed and distributed by Ward Reynolds in Calgary, Alberta, Canada. Legal, privacy, and support contact: privacy@nuttabuttainaa.com.
3. Age and guardian involvement
You must be at least 13 years old to use Vuttara. If you are under the age of majority where you live, you may use Vuttara only with the involvement and permission of a parent or legal guardian. A parent or legal guardian who permits a minor to use Vuttara is responsible for supervising that use and helping the minor understand these Terms and online risks.
4. Open-source software licence
The Vuttara source code is made available under the MIT License unless a file or component states a different licence. The MIT License governs your rights to use, copy, modify, merge, publish, distribute, sublicense, and sell copies of code covered by that licence, subject to its conditions.
These Terms do not revoke, narrow, or replace rights granted by the MIT License. These Terms instead govern the official Vuttara website, official binary distributions, update infrastructure, support, branding, and hosted services, and they apply to your relationship with Ward Reynolds when using those official offerings.
Third-party components included with Vuttara may be governed by their own licences and notices.
5. Vuttara name, branding, and website content
The MIT License does not grant permission to misrepresent an unofficial build as an official Vuttara release or to imply endorsement by Ward Reynolds. Vuttara names, logos, artwork, website design, release descriptions, and other branding or content may be protected separately from the open-source code.
You may accurately state that a project is based on or derived from Vuttara, but you must not create confusion about source, sponsorship, security review, compatibility, or official status.
6. Official software and updates
Official installers and updates are distributed through locations identified by the Vuttara website or official GitHub repository. You are responsible for checking the source and integrity of files you install. Unofficial builds, mirrors, modifications, or repackaged installers are controlled by their distributors, not Ward Reynolds.
Vuttara may check for, download, and install updates according to your settings. Updates may add, change, repair, or remove functionality; address security or compatibility; and update legal notices. Silent automatic updates may proceed without displaying interactive installer pages.
7. Vuttara Sync and other hosted services
Account-based Vuttara Sync is not currently live. No public official account-sync endpoint is currently offered. Do not submit Vuttara credentials to a website or endpoint that is not identified as official on the Vuttara website.
If Vuttara Sync or another hosted service launches, additional service terms, privacy disclosures, security information, feature limits, or eligibility requirements may apply. Hosted services may be changed, suspended, rate-limited, or discontinued.
8. Acceptable use of official services
You must not use the Vuttara website, official update infrastructure, support channels, or any hosted Vuttara service to violate law; infringe rights; distribute malware; attack, scan, overload, disrupt, or bypass security; impersonate another person; submit fraudulent information; automate abusive requests; interfere with other users; or obtain unauthorized access to systems or data.
This acceptable-use section does not prohibit legitimate security research, interoperability work, modification, or redistribution permitted by an applicable open-source licence, provided the activity is lawful and does not attack official infrastructure or misrepresent an unofficial build as official.
9. Third-party websites, services, and content
Vuttara is a general-purpose browser. It can display or interact with websites, downloads, media, extensions, protocols, search providers, and services controlled by third parties. Ward Reynolds does not control and is not responsible for their content, availability, legality, accuracy, security, tracking, terms, privacy practices, transactions, or conduct.
Links, search results, warnings, blocker decisions, reputation information, or compatibility behaviour are not endorsements or guarantees. You are responsible for deciding whether to visit a site, grant a permission, provide information, download a file, enter into a transaction, or rely on third-party content.
10. User data, backups, and device security
You are responsible for your Vuttara profiles, local browser information, downloaded files, recovery keys, passwords, device security, and backups. Features intended to protect or recover information are not a substitute for independent backups and appropriate Windows account security.
Clearing data, resetting a profile, deleting a profile, uninstalling software, replacing files, changing sync storage, or losing a recovery key may cause permanent loss. Review confirmation messages and maintain backups before destructive actions.
11. Security and feature limitations
Vuttara includes privacy and security controls, but no browser can guarantee anonymity, uninterrupted operation, compatibility with every website, detection of every tracker or malicious file, prevention of every exploit, or protection from a compromised device or network.
Features may be experimental, depend on Electron, Chromium, Windows, GitHub, Cloudflare, network conditions, website behaviour, or third-party services, and may change or fail without notice.
12. Support and feedback
Support is provided on a reasonable-efforts basis and is not guaranteed. You are responsible for removing secrets and unrelated personal information from reports before submitting them.
If you provide ideas, suggestions, bug reports, or other feedback, you grant Ward Reynolds a non-exclusive, worldwide, royalty-free permission to use, reproduce, modify, and incorporate that feedback for Vuttara without an obligation to compensate you. This does not transfer ownership of your pre-existing code or content.
13. Availability, modification, and discontinuation
Official websites, downloads, updates, support, and hosted services may be unavailable, changed, restricted, or discontinued. Where reasonably practical, material changes affecting current official services will be communicated through the website, release notes, or application notices.
14. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OFFICIAL VUTTARA SOFTWARE, WEBSITE CONTENT, DOWNLOADS, UPDATES, SUPPORT, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR COLLATERAL, INCLUDING WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, ACCURACY, AVAILABILITY, OR ERROR-FREE OPERATION.
Nothing in these Terms excludes a warranty, condition, remedy, or consumer right that cannot lawfully be excluded or limited. The MIT License contains its own warranty disclaimer for software covered by that licence.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WARD REYNOLDS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL LOSS; LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA, CREDENTIALS, OR DEVICE USE; OR COSTS OF SUBSTITUTE SERVICES ARISING FROM OR RELATED TO VUTTARA, EVEN IF ADVISED THAT SUCH LOSS MAY OCCUR.
WHERE LIABILITY CANNOT BE EXCLUDED, THE TOTAL AGGREGATE LIABILITY ARISING FROM THE OFFICIAL WEBSITE, BINARY DISTRIBUTION, UPDATE SERVICE, SUPPORT, OR A HOSTED SERVICE WILL NOT EXCEED THE GREATER OF CAD $50 OR THE AMOUNT YOU PAID DIRECTLY TO WARD REYNOLDS FOR THE SPECIFIC OFFICIAL SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. This limitation does not apply where prohibited by law, including liability that cannot be limited for fraud, wilful misconduct, gross negligence, death, personal injury, or mandatory consumer rights.
16. Suspension and termination of hosted access
Access to an official hosted service or support channel may be limited or terminated where reasonably necessary to address abuse, security risk, legal requirements, non-payment for a future paid service, or material breach of these Terms. Termination of an official hosted service does not terminate rights already granted under the MIT License to code covered by that licence.
17. Governing law and disputes
These Terms are governed by the laws of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles. Subject to any mandatory consumer forum or small-claims right, the courts located in Calgary, Alberta will have exclusive jurisdiction over disputes connected with these Terms or official Vuttara services.
Before starting a formal claim, you agree to send a written description of the issue to privacy@nuttabuttainaa.com and allow at least 30 days for an informal resolution, unless urgent relief or a limitation period makes that impractical.
18. Changes to these Terms
These Terms may be updated to reflect changes in Vuttara, hosted services, law, security, or business practices. The updated Terms will identify a new “Last updated” date and document version. Material changes may require renewed acceptance in an interactive installer or hosted-service interface. Continued use after an applicable effective date constitutes acceptance where permitted by law.
19. General terms
If part of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign a hosted-service account or contractual rights under these Terms without written permission, but Ward Reynolds may assign these Terms as part of a transfer of Vuttara operations, subject to applicable law. Headings are for convenience only.
These Terms, the Privacy Policy, and any additional terms presented for a specific future hosted service form the agreement governing the official offering. Open-source licence terms remain separately controlling for code covered by those licences.
